Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Product Pricing and Description
The product price displayed on our Website represents the full retail price listed for the product itself. Such list price is a comparative price estimate and may or may not represent the prevailing price in every area on any particular day. For certain products that are offered as a set, the list price may represent an “open-stock” price, which means the aggregate of the estimated or suggested retail price for each of the products included in the set. Where a product is offered for sale by us, the list price will be provided by us. In cases of mispriced products in our catalogues where a product’s correct price is higher than our listed price, we will, at our discretion, either contact you for instructions before shipping or cancelling your order and notify you of such cancellation.
We do not warrant that product descriptions or other content on this Website is accurate, complete, reliable, current, or error-free. If a product offered on our Website is not as described, your sole remedy is to return it in unused condition as per our Returns & Exchange policy
Shipping & Delivery
Delivery Timelines: We will make every effort to get your order delivered to you as per your convenient/ chosen available slot.
- The products ordered by you shall be available for delivery as per allotted delivery slot which would depend on your location. Depending on location, we will deliver your products on the next day, or day after tomorrow from the point of ordering. If you fail to take delivery for any reason, your order and delivery thereof shall be treated as cancelled.
- The person authorized to deliver the product may decline to deliver the product if he finds any inconsistency as regards Order No. or any other detail of the order.
iii. Subject to availability of the ordered product on the delivery day, Berrydale Foods shall deliver the product to you as per schedule, failing which Berrydale Foods shall inform you with a revised schedule for delivery of the product. You may ask for cancellation/ modification of order on account of this.
- It is your responsibility to count and check all the products while accepting the products as per your order.
- No dispute will be entertained by Berrydale Foods once you accept the products.
- You shall accept the product without demur in the following circumstances:
- If the products delivered to you are in accordance with your order, or
- Loose Fruits and Vegetables with minor weight variation due to moisture loss.
We request you to check all the products at the time of delivery or pick up. Complaint pertaining to short weight will not be entertained, if the complaint is not lodged at the time of delivery.
Shipping Charges: Delivery charge will be leviable for each delivery. However Berrydale Foods may run certain promotions/ offers or prescribe minimum order value for each transaction to waive the delivery charges, which is conditional.
Delivery Locations: We currently deliver orders to selected pin codes/ areas across cities within India only. You may check the delivery serviceability of your area/ locality check with our customer care/ support team at www.berrydalefoods.com Only limited areas are serviceable, and even those listed serviceable areas can be cancelled owing to extraordinary circumstances.
International Delivery: We do not deliver internationally.
Returns and Exchanges
We follow a ‘no questions asked’ return or exchange policy provided the following are fulfilled:
- image of the product/s is/are shared by you if asked by us.
- you must raise a request by emailing us on [email protected] within a maximum period of 48 hours of receipt of your order.
- product packaging, labels and tags are intact and are not tampered with.
- product must be in perfect condition.
- request for product to be exchanged will be processed only once the earlier product shipped has been received by us and has been checked for quality and damages, if any.
- refunds will be processed only for damaged or defective products in the form of store credit. Please note that the shipping charge of Rs. 100/-, if levied, will not be refunded.
- for prepaid orders, in case of order cancellations or orders that go to abandoned cart, refund will be processed back to you via our payment gateway. Timeline for such refund will be about 5-7 working days.
- once you have requested for a return/exchange, such product will be collected by us within 7 working days.
- if you choose to self-ship the products to us at any of our authorized locations, they should be dispatched within 48 hours after the return request is raised and packed securely to prevent any damage during transit, the loss or damage thereto, if any, shall be to your sole account.
Cancellation
The whole order amount for the products ordered by you will be refunded if the order is cancelled, lost or undelivered to your preferred location.
Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
Governing Law
These Terms shall be governed and construed in accordance with the laws of India without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
